Help! My ADU is illegal.

Prior to recent state laws forcing local jurisdictions to simplify ADU approval, many property owners chose to construct units without the proper permits.

It is estimated that 70% of construction in unincorporated Marin has been non permitted.  

The large numbers of non permitted ADUs in Marin present many risks to both the occupants and the property owners. Getting these units properly permitted is now possible through new California ADU law, but it can be a bit complex.  

Property owners must provide drawings to their local jurisdiction and apply as if they were building a new ADU. For such plans to be approved, life safety code-related issues may first need to be addressed.

Examples of frequent code violations include not having the following:

  • Minimum ceiling height  requirement
  • Proper drainage or waterproofing
  • Sufficient means of ingress/egress
  • Properly sized or placed windows
  • Electrical or  plumbing to code
  • Permanent heating
  • A deadbolt on main entry door
